Further to the use of EADS Audit Committee draft documents and their publication in the press, the company, represented by its two Chief Executive Officers Tom Enders and Noël Forgeard, filed a complaint against unknown persons (including suit for damages). The complaint was filed on 28 June with the competent Examining Magistrate in Paris. The legal ground of the complaint are theft, harboring and unauthorized disclosure of strictly internal and confidential draft documentation, which is company property. Additionally, the Group has set up an internal investigation.
EADS is shocked to find a strictly internal and confidential draft document and company proprietary information in the press. This draft document appears to be used deliberately with the intention of pointing to alleged Franco-German tensions, which are not existing and which the draft document itself does not even evidence in any way, shape or form. Besides the already initiated actions EADS reserves all its rights in the circumstances.
